Subject: ACTION: Highway Safety Improvement Program Reporting
Requirements under Title 23, Section 148(g)

Section 1401 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users Act (SAFETEA-LU) amended Section 148 of Title 23 of the United States Code (USC) to create the Highway Safety Improvement Program (HSIP) as a new “core funding” program administered by the Federal Highway Administration (FHWA). As a part of the new HSIP, States are required to submit a report that describes the progress being made to implement highway safety improvement projects and provide assessment of the effectiveness of these improvements. This requirement is in Section 148(g) of 23 USC, and the purpose of this memorandum is to transmit interim guidance for preparing this report. Reporting on the High Risk Rural Roads set aside within the overall HSIP required by Section 1408(f) of 23 USC is also included in this guidance.

The report is to be completed annually and submitted to the FHWA Division Offices on or before August 31. The Division Office should forward the reports to the FHWA Headquarters Office of Safety by September 30. At the option of each State, this report may be submitted separately or combined into one report with three distinct sections to include other reports required by the new HSIP; i.e., the “5% Report” under Section 148(c)(1)(D) and the report on the railway-highway crossing program under Sections 130 and 148(g), 23 USC. Submission of electronic files is encouraged.

Modifications to this guidance may be necessary as a result of review by the Office of Management and Budget under the Paperwork Reduction Act. This process, which includes publication of the reporting requirement in the Federal Register for comment, is now underway and is expected to take approximately 6 months to complete. If changes are necessary as a result of this process, we will issue revised guidance.
