Patient Protection and Affordable Care Act National Initiatives Information

The Patient Protection and Affordable Care Act (PPACA), also known as, “Health Care Reform” or "Obamacare," was passed by Congress and signed into law by the President on March 23, 2010.

South Dakota was a leader among states opposing PPACA, joining many other states in challenging the law in court. On June 28, 2012, the Supreme Court rendered a final decision to uphold the PPACA. The law contains provisions to reform the health insurance industry, with the biggest changes occurring by January 2014. Although Governor Daugaard hopes for the repeal of PPACA, the ruling requires the State of South Dakota to act in accordance with the Patient Protection and Affordable Care Act law being implemented by the Federal Government.

The State of South Dakota is not running a State-Based Marketplace, which means that under federal law, South Dakotans are part of a Federally Facilitated Marketplace. During the annual Open Enrollment period, an online portal is available for individuals to enroll for coverage through the Marketplace in the Individual market. An online portal is available for the Small Group markets online portal as well. The Marketplace is also the venue for federal tax credits.

This site is maintained by the State of South Dakota.  It is designed to provide links to useful resources related to Federal Health Reform. Even though the state leaders oppose PPACA, South Dakotans need to understand how this law affects them.
