Unlocatable Mineral Trust

Download the Unlocatable Trust Spreadsheet and Search for Unlocatable Mineral Trust

We administer trusts where we have been named as trustee. The funds are invested and the claimant will receive 50% of the interest earned.

File a Notice of Address to Claim Trust Funds

File with the Clerk and Recorder of county in which the interest in minerals is located.

Payment of $5.00 is required.

82-1-306. Filing of Addresses
(1) Upon the payment of a $5 fee, a person claiming an interest in minerals underlying a tract of land that is the subject of a trust proceeding under 82-1-302 may file with the clerk and recorder of each county in which the land is located a notice containing the person's address and a description of the person's interest in the minerals. Filing the notice creates a rebuttable presumption that the person owns the interest claimed.
(2) The clerk and recorder shall forward a copy of the notice to the trustee of the trust.

The Counties May Be Trustees

The court will appoint the clerk of court as trustee; the clerk of court may decline to act as trustee. The Department of Revenue will be named as trustee if the clerk of court declines to act as trustee.

What Is an Unlocatable Mineral, Leashold, or Royalty Interest Trust?

A trust is created for an unlocatable mineral, leasehold or royalty interest owner so that the trustee can execute and deliver documents on the terms and conditions as the court may approve. The trustee will invest the funds and keep the trust in force until the funds are claimed.
