UPDATE: Harlan v. Scholz Election Day In-Precinct Registration Lawsuit
On this date, the Seventh Circuit Court of Appeals issued its order denying the Plaintiffs’ request to expedite the appeal. A briefing schedule has been set, with briefing not scheduled to be completed until well after Election Day. Accordingly, absent a successful appeal of today’s order, counties with a population of 100,000 or more, and counties with a population of 100,000 or less but with electronic poll books, remain required to provide voters the option of registering and voting at polling places on Election Day. As always, should there be any change, we will advise you immediately.

Notice to IDIS 3.0 Users Regarding Google Chrome
Some Google Chrome users have experienced problems using the IDIS 3.0 electronic filing system. This appears to be due to a password saving feature in the Chrome browser that inadvertently causes the wrong password to be entered in IDIS when logging into an account or attempting to file a report. If the saved password has been changed, or if the user files reports for more than one committee, Chrome may automatically enter the original saved password even if the user attempts to type in a different one.
Users who experience this problem are advised to either log into the IDIS system through a different browser, or to delete any saved passwords in Google Chrome and not use the browser’s password saving feature for the IDIS system.
To delete a password in Google Chrome:
Open the Chrome browser and click Menu at the top right.
Choose Settings
At the bottom, click Show Advanced Settings
Under Passwords and forms, click Manage passwords. A box will appear with a list of saved passwords.
In the Saved passwords section, select any entries for the IDIS website and click Delete.
Click Done.

Form D-4 - Complaint for Violation of the Campaign Disclosure Act
Any campaign disclosure complaint dealing with a candidate or question of public policy appearing on the November 8 General Election Ballot and received by the Board by Friday, October 7th, will be brought to the Board for consideration at the October 18th Board meeting. Any campaign disclosure complaint received by the Board between Tuesday, October 11th and Thursday, October 27th will be brought to the Board for consideration at a special Board meeting to be held prior to the election (date to be determined). Any campaign disclosure complaint received by the Board after Thursday, October 27th will be brought to the Board for consideration at the Monday, November 21st Board meeting.
In addition, any such complaint filed prior to October 28th must be personally served (not just mailed) upon all respondents prior to the time the complaint is filed with the Board, and the proof of service on the back of the D-4 Form must indicate that it has been so served. Complaints not having been personally served or lacking the requisite proof of service will be deemed to have been filed after October 27th and will not be heard by the Board until the November 21st meeting at the earliest.

The 2017 Election and Campaign Finance Calendar contains the specific date entries required in the nomination and/or election of officials of municipalities, townships, libraries, parks, school districts and other special purpose districts.
The Candidates Guide for 2017 has been prepared to provide information for candidates seeking office at the local level in 2017. It includes a listing of offices nominated or elected at the Consolidated Primary Election on February 28 and at the Consolidated Election on April 4.

The filing period for the June 2016 Quarterly Report ends Friday, July 15. The June 2016 Quarterly Report must include all committee activity from April 1 up to and including June 30. The Board must receive this report by 5:00 p.m. on Friday, July 15 when filing on paper, or by 11:59:59 p.m. on Friday, July 15 when filing electronically.
This Quarterly Report must be filed by all active political committees; it must be filed regardless of whether the committee had any activity during that period of time.

Unofficial local results are not reported to the State Board of Elections or posted to the Agency’s website. Unofficial election day results may be obtained by accessing the local jurisdiction’s website as provided. Some jurisdictions do not have web sites; phone numbers are provided for all jurisdictions. The State Board of Elections will certify the results from the March 15th primary on APRIL 15th. Results can be found on our website at that time.

Any campaign disclosure complaint received by the Board between Monday, February 8th and Thursday, March 3rd will be brought to the Board for consideration at a special Board meeting to be held prior to the election (date to be determined). Any campaign disclosure complaint received by the Board after Thursday, March 3rd will be brought to the Board for consideration at the Friday, April 15th Board meeting.
In addition, any such complaint filed prior to March 4th must be personally served (not just mailed) upon all respondents prior to the time the complaint is filed with the Board, and the proof of service on the back of the Form D-4 must indicate that it has been so served. Complaints not having been personally served or lacking the requisite proof of service will be deemed to have been filed after March 3rd and will not be heard by the Board until the April 15th meeting at the earliest.

Important Notice Regarding Independent Expenditure Reporting
Year-round Schedule B-1 reporting is now required for political committees making independent expenditures of $1,000 or more.
A previous mailing to political committees indicated the effective date for these changes was July 1, 2016, but the new requirements actually went into effect January 1, 2016. We apologize for any inconvenience or confusion this may have caused.
Each independent expenditure of $1,000 or more must be reported electronically on a Schedule B-1 report within 5 business days after making the independent expenditure, except that B-1 reports for independent expenditures of $1,000 or more made within the 60 day period before an election must be filed within 2 business days. All independent expenditures must also be reported on a committee’s quarterly reports.
Independent expenditures are roughly defined as any expenditure of funds for electioneering communications or expressly advocating for or against a clearly identifiable public official or candidate or question of public policy, provided the spending is not made in connection, consultation or concert with a public official, candidate, committee or their agents. Simply put, if a political committee expends funds on its own behalf and for its own benefit, it is not considered to be an independent expenditure.
The 2016 Campaign Disclosure Calendar is included on the back side of this notice, and includes the corrected reporting dates and requirements for Schedule B-1 independent expenditures. Notice regarding disclosure requirements in connection with the July 7 Special Primary Election
Illinois political committees required to file with the State Board of Elections may have additional campaign disclosure reporting requirements if they are participating* in the July 7, 2015 Special Primary Election in the 18th Congressional District.
*Although this is a federal election contest, any political committee is considered to be participating in the election if it makes expenditures in excess of $500 (including expenditures for in-kind contributions, electioneering communications or independent expenditures) made on behalf or or in opposition to any candidate on the ballot in the election. This only applies to political committees required to file with the State Board of Elections. It does not apply to federal committees required to file with the Federal Election Commission.
Any committee participating in the election must report receipt of contributions of $1,000 or more on a Schedule A-1 within two business days of receipt. This period covers June 7, 2015 through and including July 6, 2015. (Contributions of $1,000 or more received outside the 30 day period before an election must be reported on a Schedule A-1 within five business days of receipt.)
Any committee pariticipating in the election must report any independent expenditure** of $1,000 or more on a Schedule B-1 within five business days after making the independent expenditure. This period covers June 7, 2015 through and including July 6, 2015.
**Independent expenditures are loosely defined as any expenditure made for the purpose of making electioneering communications or expressly advocating for or against a candidate, that is not made in connection or coordination with the candidate or the candidate’s committee.

Adjustments to Contribution Limits - Effective Jan. 1, 2015
Effective January 1, 2015, the contribution limits which govern what amounts a political committee may contribute and receive will be adjusted upwards pursuant to 10 ILCS 5/9-8.5(g). This section reads as follows:
“…On January 1 of each odd-numbered year, the State Board of Elections shall adjust the amounts of the contribution limitations established in this section for inflation as determined by the Consumer Price Index for All Urban Consumers, as issued by the United States Department of Labor and rounded to the nearest $100. The State Board shall publish this information on its official website.”

Removal of Contribution Limits
Up-to-date information regarding election races where contribution limits have been removed is available on the Board’s website, either by choosing “Contribution Limits Off Search” in search options, or by clicking on the link below.
Contribution limits can be lifted in an election race if any candidate becomes a self-funding candidate, or if a sufficient level of independent expenditures is made to support or oppose a particular candidate. The removal of contribution limits becomes effective as soon as it is posted to the Board’s website, affects all candidates in a particular race, and remains in effect through the completion of the election cycle.

Filing With IDIS Version 2.0 Will No Longer Be Possible As Of August 3, 2014
All political committees currently using IDIS2 must transfer their data to IDIS3 by August 3, 2014. No reports can be filed using IDIS2 after this date.
In August 2013 we released IDIS3, a new web-based version of the software used to electronically file your disclosure reports. Some of the advantages are listed below:
• It is a web-based system whereby you can access data, enter receipts and expenditures, and file reports from any computer that has internet access.
• More than one person can be entering data simultaneously.
• You will no longer need to worry about losing your data.
• Your data will reside on the Board’s servers.

Form D-4 – Complaint for Violation of the Campaign Disclosure Act
Any campaign disclosure complaint dealing with a candidate or question of public policy appearing on the March 18th General Primary Ballot and received by the Board prior to Friday, March 7th, will be brought to the Board for consideration at the March 17th Board meeting. Any campaign disclosure complaint received by the Board after Thursday, March 6th will be brought to the Board for consideration at the Friday, April 18th Board meeting.
In addition, any such complaint filed prior to March 7th must be personally served (not just mailed) upon all respondents prior to the time the complaint is filed with the Board, and the proof of service on the back of the Form D-4 must indicate that it has been so served. Complaints not having been personally served or lacking the requisite proof of service will be deemed to have been filed after March 6th and will not be heard by the Board until the April 18th meeting at the earliest.

On 11/13/13, the State Board of Elections received a Notification of Self-Funding filed by Citizens for Rauner, Inc., on behalf of Bruce Rauner, a candidate for the office of Illinois Governor. As a result of this filing, under 10 ILCS 5/9-8.5(h), all candidates for the office of Illinois Governor are allowed to accept contributions in excess of the contribution limits imposed by 10 ILCS 5/9-8.5(b).

Adjustments to Contribution Limits - Effective Jan. 1, 2013
Effective January 1, 2013, the contribution limits which govern what amounts a political committee may contribute and receive will be adjusted upwards pursuant to 10 ILCS 5/9-8.5(g). This section reads as follows:
“…On January 1 of each odd-numbered year, the State Board of Elections shall adjust the amounts of the contribution limitations established in this section for inflation as determined by the Consumer Price Index for All Urban Consumers, as issued by the United States Department of Labor and rounded to the nearest $100. The State Board shall publish this information on its official website.”

Campaign Disclosure Tutorials now available
Three tutorials dealing with campaign disclosure filing requirements and instructions are now available on the State Board of Elections website. The tutorials cover a number of issues, including creating a political committee and filing a Statement of Organization, as well as preparing and filing Quarterly Reports and the special Schedule A-1 and Schedule B-1 filings. These tutorials are highly recommended for newcomers to campaign disclosure, but they may also provide valuable information for existing committees and candidates. The tutorials can be found on the Committees page of the website, or under the “Learning About” section of the campaign disclosure heading on the website menu. The free Adobe Acrobat Reader is required to view the tutorials.

The Illinois State Board of Elections will conduct a Special Board Meeting on Sunday, December 2, 2012 to proclaim the results from the November 6, 2012 General Election. The meeting is scheduled to begin at 5:00 p.m. in the Board’s principal office located at 2329 S. MacArthur Blvd., Springfield, IL and via video conference at McCorkle Court Reporters, Inc., 200 N. Illinois Voters Guide
The State Board of Elections announced that the Illinois Voters Guide is now available on the Board’s website at www.vote.illinois.gov. The following offices are eligible to participate in the program: United States President, United States Representative, Illinois Supreme Court Judge and Illinois Appellate Court Judge.
New for the 2012 Voters Guide is a feature which will enable the candidate profiles to be translated into 64 languages.

New Legislation Impacts Candidates and Voters
Section 7-43 of the Election code was amended by Public Act 97-0681 on March 30, 2012. This legislation will have a significant impact on candidates who filed a Statement of Candidacy and/or Voters who voted at the 2012 General Primary Election.
The April 5, 2012 Press Release follows:
Springfield, Illinois, April 5, 2012 - Public Act 97-0681, which became effective on March 30, 2012, amends section 7-43 of the Election Code (10 ILCS 5/7-43). This amendment provides that a person who files a statement of candidacy as an established party’s candidate at a General Primary Election or who voted an established political party’s ballot at the General Primary Election may not file a statement of candidacy as an independent candidate or as a different established party’s candidate at the immediately following General Election.
For example, if a candidate filed a statement of candidacy for the 2012 General Primary Election or a voter voted at the 2012 General Primary Election, that candidate or voter could not appear as either an independent candidate or as a different established party’s candidate on the 2012 General Election ballot.
A candidate who filed as an established party’s candidate for the 2012 General Primary Election and either withdrew as a candidate or was removed by an electoral board proceeding would not be eligible to file as either an independent candidate or as the candidate of a different established political party. That candidate’s only option would be to file as a member of a new political party slate.
Candidates who appeared on the 2012 General Primary ballot and were defeated for nomination would be prohibited from appearing on the 2012 General Election ballot as a candidate of another established political party, an independent candidate or a new political party candidate under the “sore loser” provisions of the Election Code (10 ILCS 5/7-61, 10-2 and 10-3).
The State Board of Elections is an independent state agency charged with the responsibility of having general supervision over the administration of election laws of the state. Elections are administered locally by the State’s 110 election authorities.

Personal PAC v. William M. McGuffage, et al. No. 12-CV-1043
On March 13, 2012, in a case filed by Personal PAC (12-CV-1043), a U.S. District Court ruled that the Illinois State Board of Elections could not enforce two provisions of the Campaign Disclosure Act as they relate to committees solely making independent expenditures. The first section, 10 ILCS 5/9-8.5(d) deals with contribution limits, and the second section, 10 ILCS 5/9-2(d), deals with the number of political action committees an entity can legally form.
What does this ruling mean to you and to your political committees?
This ruling has no effect on any political committee other than one formed SOLELY for making independent expenditures.
Contribution limits are still in effect for Candidate Political Committees, Political Party Committees, and Political Action Committees which make coordinated expenditures or direct contributions to candidates or committees. The ruling allows an entity formed for the purpose of making independent expenditures ONLY, to create a Political Action Committee that is not bound by contribution limits. That Political Action Committee, which will be designated as an Independent-Expenditure-Only PAC, must still register with the SBE and must file all required disclosure documents when it reaches the $3000 filing threshold. It must report all receipts and expenditures and itemize those in excess of $150 on its quarterly reports. It must file a Schedule A-1 within 5 or 2 business days, (depending on when the contribution is received) whenever it receives a contribution of $1000 or more. It must also file a Schedule B-1 within 5 business days when it makes an aggregate of $1000 in independent expenditures within the 30 days prior to an election.
This ruling allows an entity to have more than one Political Action Committee, provided the second committee is an Independent-Expenditure-Only PAC created only to make independent expenditures. Such committee may NOT make direct contributions or coordinated expenditures. The committee created to make independent expenditures only, is not subject to contribution limits; the Political Action Committee making direct contributions IS STILL subject to contribution limits. A Political Action Committee making direct contributions may also make independent expenditures without forming a second PAC, but it must still abide by the contribution limits.
What is an independent expenditure?
According to 10 ILCS 5/9-1.15, “Independent expenditure” means any payment, gift, donation, or expenditure of funds (i) by a natural person or political committee for the purpose of making electioneering communications or of expressly advocating for or against the nomination for election, election, retention, or defeat of a clearly identifiable public official or candidate and (ii) that is not made in connection, consultation, or concert with or at the request or suggestion of the public official or candidate, the public official’s or candidate’s designated political committee or campaign, or the agent or agents of the public official, candidate, or political committee or campaign.”

The Report of the General Counsel includes among other things, consideration of campaign disclosure items including Appeals of civil penalty assessments, Complaints following closed preliminary hearing, Motions to Reconsider and Settlement offers of civil penalties. Though it is not certain what time the Report of the General Counsel will commence, the Board suggests interested parties arrive no later than 10AM. The principal location of the Board meeting is at the James R. Thompson Center in Chicago, located at 100 W. Randolph, Ste: 9-040. However, as in past meetings, the Chicago location will be connected to the Board’s Springfield office via videoconference. Please note that the Springfield office is now located at 2329 S. MacArthur Blvd. in Springfield Illinois.

The State Board of Elections is Relocating its Springfield Office Beginning February 10, 2012
The State Board of Elections will be relocating its Springfield office to 2329 S. MacArthur Blvd., Springfield, IL 62704-4503 beginning 1PM Friday February 10, 2012. All Springfield office telephone systems will be taken down at that time and remain inoperative until 8AM, Tuesday, February 14, 2012, at which time the Springfield office will reopen at the new location. Note: A limited number of the Board’s Chicago office telephone numbers, including the main switchboard (312-814-6440), will remain active. Additionally, the agency’s website (including the electronic filing of Campaign Disclosure reports) will remain up and running during the transition.

Campaign Disclosure -- Quarterly Report Filing Deadline – Tuesday, January 17, 2012
The filing period for the December 2011 Quarterly Report ends Tuesday, January 17th. The December 2011 Quarterly Report must include all committee activity from October 1st through December 31st. The Board must receive this report by 5:00 p.m. on Tuesday, January 17th when filing on paper or by 11:59:59 p.m. on Tuesday, January 17th when filing electronically.
This Quarterly Report must be filed by all active political committees; it must be filed regardless of whether the committee has had any activity during that period of time.
If filing on paper, reports must be postmarked by Saturday, January 14th to be considered a timely filing if received after the deadline.

A Report from the Illinois Campaign Finance Reform Task Force
The Campaign Finance Reform Task Force was established in 2010 to conduct a thorough review of the implementation of campaign finance reform legislation in the State of Illinois, and the feasibility of implementing a mechanism of campaign finance regulation that would subsidize political campaigns in exchange for voluntary adherence to specified expenditure limitations (10 ILCS 5/9-40).
The Task Force is charged with studying and reporting on the feasibility of implementing a mechanism of campaign finance regulation that would subsidize political campaigns in exchange for voluntary adherence to specified expenditure limitations.
The attached report on Public Campaign Financing and Illinois Elections (i) outlines the history and development of public campaign finance in the United States and in Illinois; (ii) examines the public policy arguments in support of and in opposition to the development and implementation of a public campaign finance system in Illinois; (iii) explains and analyzes the current state of the law with respect to public campaign finance; and (iv) offers several feasible alternatives on how a public campaign finance system might be implemented in Illinois. The report does not include a consensus recommendation regarding public financing, but rather, presents various options related to the adoption of public financing.

Press Release regarding recent Federal Court Decision on challenge to Congressional District Map
On Thursday, December 15, the State Board of Elections received notice that a three judge panel for the United States District Court for the Northern District of Illinois ruled in favor of the defendants and has dismissed the lawsuit brought by Committee for a Fair and Balanced Map, et al. v. Illinois State Board of Elections, et al., No. 11-c-5065. It is not known whether the Plaintiffs intend to appeal or seek reconsideration of this decision. The Board however, wishes to inform candidates for the office of Representative in the United States Congress that the dates previously established by Court Order are still in effect and are as follows:
• Friday, December 23, 2011, 8:00 a.m.: First day to file for candidates seeking the office of Representative in the U.S. Congress
• Tuesday, December 27, 2011, 5:00 p.m.: Last day to file for candidates seeking the office of Representative in the U.S. Congress (Please note that the Board offices will be closed on December 24th, 25th and 26th in observance of the Christmas Holiday.)
• Wednesday, January 4, 2012, 1:00 p.m.: Last day for filing objections to the nominating petitions of candidates who have filed for the office of Representative in the U.S. Congress.

One-time Amnesty – 2011 March Quarterly Report
Beginning January 1, 2011, Political Committees were required to file a Quarterly Report covering the reporting period of January 1, 2011 through March 31, 2011. This Report was due no later than April 15, 2011. As of this posting, numerous Committees have failed to do so. In light of the fact that this is the first instance of reporting on a quarterly basis and the large number of non-filings, the SBE has decided to grant a one-time only amnesty to any political committee that files this report with the SBE on or before JUNE 11, 2011. Specifically, if the Quarterly Report is filed and received by the SBE on or before JUNE 11, 2011, that committee will not be assessed a civil penalty. However, if this Quarterly Report is not filed by June 11, 2011, a Complaint will be filed against the Committee, and civil penalties of up to $5,000 may be assessed as a result of the failure to file. In addition, if the Quarterly Report is filed after June 11, 2011, it will be assessed a civil penalty accruing from the original deadline of April 15.
We understand that the filing of this Quarterly Report represented a major change in the reporting and filing schedule for political committees, which is primarily why the SBE is granting this one-time only amnesty. If your political committee has not yet filed its Quarterly Report, please take advantage of this amnesty by filing such report immediately.

Changes to the Business Registration (BEREP) rule, Title 26, Part 100.180
The State Board of Elections has proposed changes to the Business Registration (BEREP) rule, Title 26, Part 100.180. This rulemaking provides a mechanism for business entities that do not have existing State contracts or pending bids on State contracts, and that have met all time requirements to update business information, to include, on their registration, the fact that they are currently inactive. This amended language was sent to the Index Department of the Office of the Secretary of State for publication in the Illinois Register. A political committee that receives a contribution of $1,000 or more starting January 1, 2011, will need to file a Schedule A-1 within 5 business days of receipt of the contribution. Consent Decree with the Department of Justice
The State Board of Elections, in its capacity as the Chief Election Official, has entered into an agreement with the Department of Justice to enforce provisions of the Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA) and the Military and Overseas Voter Empowerment Act (MOVE) to ensure that all military personnel and U.S. citizens living overseas will have their absentee ballots counted for the November 2, 2010 General Election.

Please be advised that according to the Illinois Election Code, military and overseas ballots postmarked by midnight, November 1, can be counted up to 14 days following the election.
“10 ILCS 5/20-2 Ballots voted under this Section must be returned postmarked no later than midnight preceding election day and received for counting at the central ballot counting location of the election authority during the period for counting provisional ballots, the last day of which is the 14th day following election day.”

Absentee Voting
Absentee voting for the November 2, 2010 General Election is currently underway in Illinois. Recent changes in state law have eliminated both the requirement that voters specify a reason why they must vote absentee and that the application for an absentee ballot be on a form provided by the appropriate Election Authority. As a result, any qualified elector in Illinois who is properly registered may vote by absentee ballot (military personnel, their spouses and dependants, and overseas non-resident civilians may vote absentee without prior registration). Changes to 2010 Election Calendar Due to Recent Legislation
The 2010 Election Calendar has been amended due to recently enacted legislation, Public Act 96-1008 (Senate Bill 3012), effective July 6. Natural Person Independent Expenditure Disclosure
A natural person who makes an independent expenditure supporting or opposing a public official or candidate that, alone or in combination with any other independent expenditure made by that natural person supporting or opposing that public official or candidate during any 12-month period, equals an aggregate value of at least $3,000 must file a written disclosure with the State Board of Elections within 2 business days after making any expenditure that results in the natural person meeting or exceeding the $3,000 threshold. Each disclosure must identify the natural person, the public official or candidate supported or opposed, the date, amount, and nature of each independent expenditure, and the natural person’s occupation and employer.

Public Hearings on proposed Campaign Finance Reform Rulemaking
The State Board of Elections will conduct public hearings on a proposed administrative rule amending Title 26, Part 100 and Part 125. These amendments implement changes to the Campaign Finance Act resulting from the passage of Public Act 96-832.
The public hearings will take place at the same time as the Special Board Meetings on Wednesday, June 2, 2010 at the DeKalb County Legislative Center, 200 North Main Street, Room 100, Sycamore, Illinois and Thursday, June 3, 2010 at the Madison County Board Office, 157 North Main Street, Suite 203, Edwardsville, Illinois. The hearings are scheduled to begin at 1:00 p.m. and will last a minimum of one hour in both locations.

Attention Objectors And Candidates
The initial meeting of the Illinois State Officers Electoral Board (SOEB) will take place on May 3rd, 2010 at 3:30 P.M. The meeting will be held in Room 9-040 in the James R. Thompson Center, 100 W. Randolph in Chicago. The meeting can also be attended in the Springfield Office of the State Board of Elections at 1020 S. Spring St. The meeting will be connected via videoconference. The purpose of the initial meeting of the SOEB is to call the cases, accept appearances of the parties, adopt the Rules of Procedure and appoint the hearing officers who will preside over the cases. The parties must attend this first meeting or their cases may be dismissed (objectors) or their petitions may be disqualified (candidates). Case management conferences between the parties and their assigned hearing officers will take place at the conclusion of the meeting of the SOEB.
The Rules of Procedure, the Hearing Officer List, and the docket of cases will be posted following the initial meeting.
