Hiring an Attorney

As an injured employee in Texas, you have the right to hire an attorney to assist you on your workers' compensation claim.

If you have a dispute in your claim, it might go through one or more steps in the Division of Workers' Compensation's hearings process, including:

  • Benefit Review Conference
  • Contested Case Hearing
  • Appeals Panel Review
  • Judicial Review:
    • If you are not satisfied with the final decision of the Division of Workers' Compensation, you may appeal the decision to the district court or the county court at law in the county where you live.
    • A party may seek judicial review by filing suit not later than the 45th day after the date on which the division mailed the party the decision of the appeals panel.  (For purposes of this section, the mailing date is considered to be the fifth day after the date the decision of the appeals panel was filed with the division.)
    • The Office of Injured Employee Counsel is not able to help you at this level.
    • You will likely need to hire an attorney or chose to represent yourself at this stage of the process.
