Nurse Aide and Nontechnical Services Worker Registry

IMPORTANT NOTICE REGARDING NEW LAW CHANGE

New law (HB1435) starting November 1, 2015, requires nurse aides and trainees to provide their current address to the State Department of Health's nurse aide registry and notify the registry of any change in address within ten days.  Correspondence will be sent to the address on file with the registry, and if it is returned as not deliverable it will be considered legally served.
 
The new law permits the Department to suspend or revoke a nurse aide certification for cause, such as criminality revealed by a background check or any abuse, neglect or exploitation of residents under the aide’s care.  
 
Below are the bullet points of the changes to Title 63 O.S., Section 1-1951(A)(7), (D)(3)(b), and (D)(8).  

• Certified nurse aides and nurse aide trainees shall maintain with the registry current residential addresses and shall notify the registry, in writing, of any change of name.  Notification of change of name shall require certified copies of any marriage license or other court document which reflects the change of name.


• Notice of change of address or telephone number shall be made within ten (10) days of the effected change.  
Notice shall not be accepted over the phone.  


• In any proceeding in which the Department is required to serve notice or an order on an individual, the Department may send written correspondence to the address on file with the Registry.  If the correspondence is returned and a notation of the United States Postal Service indicates “unclaimed” or “moved” or “refused” or any other non-delivery markings and the records of the Registry indicate that no change of address as required has been received by the Registry, the notice and any subsequent notices or orders shall be deemed by the court as having been legally served for all purposes. 

 
• Basically this means aides must mail a change of address or phone number to the registry a within 10 days of that change. There is  form on our website for submitting address changes. If an aide is served a Petition for Hearing and it comes back to the Department and indicates “unclaimed” or “moved” or “refused” or any other non-delivery markings, it will still be considered legally delivered and any pending action can proceed. This may result in the individual’s certification being suspended or revoked and a finding of abuse, misappropriation, or neglect placed on the registry.

Revised Barrier Offenses for Nurse Aides and Nontechnical Service Workers

Note: While the HB2582 passed with an effective date of November 1, 2012, the law authorized staggered implementation through rulemaking. However, see below links to the revised barrier offenses for Nurse Aides and Nontechnical Services Workers, which are effective November 1, 2012. Effective dates for fingerprinting will be sometime after January 1, 2013, and will be established through rulemaking and after further notice. Nurse Aide Registry

The Registry was created through a federal mandate and regulations dated September 1991. The duties of the nurse aide registry include: (1) review and approve/disapprove nurse aide training program curriculum; (2) review and approve/disapprove nurse aide training programs; (3) review and approve/disapprove nurse aide testing; (4) develop and maintain the nurse aide and non-technical services worker registry (5) maintain the abuse registry; (6) certify nurse aides; (7) provide public education; and (8) develop rules, policies, procedures, applications and forms necessary to implement the program.

The Nurse Aide Registry serves unlicensed persons and employers of these persons, who provide nursing or nursing-related services to individuals receiving services in long term care facilities, home health agencies, intermediate care facilities for the mentally retarded, residential care facilities, and adult day care centers.

"Nurse aide" means any person who provides, for compensation, nursing care or health-related services to residents in a nursing facility, a specialized facility, a residential care home, continuum of care facility, assisted living center or an adult day care center and who is not a licensed health professional. Such term also means any person who provides such services to individuals in their own homes as an employee or contract provider of a home health or home care agency, or as a contract provider of the Medicaid State Plan Personal Care Program [Title 63 O.S. Section 1-1950.1(A)].

Nontechnical Services Worker (NTSW) Abuse Registry

The NTSW Abuse Registry is authorized under Title 63 of the Oklahoma Statutes at Section 1-1950.6 et seq. and identifies only those nontechnical services workers that have had an administrative finding of abuse, verbal abuse, or exploitation of a resident in a nursing facility. This registry is incorporated into the abuse registry for nurse aides.

"Nontechnical services worker" means a person employed by a nursing facility to provide, for compensation, nontechnical services in or upon the premises of a nursing facility. The term "nontechnical services worker" shall not include a nurse aide, or any person who is exempt from the criminal arrest check provisions of Section 1-1950.1 of this title; and

"Nontechnical services" means services that:

a. are performed in or on the premises of a nursing facility and that are predominantly physical or manual in nature, and
b. involve or may involve patient contact including, but not limited to, housekeeping, janitorial or maintenance services, food preparation and administrative services.

Special Announcements
The processing time for nurse aide re-certification applications is now within 1 week if all documents are properly filled out and there is not a tax hold. Please be aware of the time it takes to go through the mail, our OSDH receiving, and then finance before it gets to the Nurse Aide Registry. When we receive it, it will be processed in the current daily batch we are working in. It will show up on the Nurse Aide Registry database as soon as it is processed. Cards are mailed out every week, but you are certified when it is processed and entered into the NAR database. Your employer can verify your certification on the website or by calling (405) 271-4085.

Notice: Effective July 1, 2008, nurse aides working private duty will no longer be able to use this employment for certification renewal. Nurse aides may contact the Nurse Aide Registry for retest information at (405) 271-4085.

Q: How long does it take for the Nurse Aide Registry to receive "overnight" Express Mail?
A: It is received and "signed for" by the Health Dept. Shipping and Receiving the next day. It then goes from Shipping and Receiving to Finance (if a payment is included). It is then forwarded to the Nurse Aide Registry. This process may take three to four business days.

Q: Can I take an online (web-based)class for certification?
A: No!
