Request for Records On December 1, 2003, Congress enacted the Privacy Act of 2003 which protects the display, sale or purchase of social security numbers and/or any personal identifying information that could lead to fraud or identity theft. To obtain bankruptcy records for a case filed prior to December 1, 2003, and that has been closed for more than 1 year you may do either of the following:

Contact the attorney who represented you in the bankruptcy proceeding. The attorney is required by law pursuant to Local Bankruptcy Rule 5005-4(7) to retain any documents that require original signatures for four years after the closing of the case. Please note that the attorney may charge a fee.

Contact the Clerk's office in writing to request a copy of your records. If you are unsure what documents you need and how many pages there are, you may contact the case administrator assigned your case number by clicking on the following link: Case Administrator Assignments. There is a $30.00 record search fee plus $.50 per page copy charge.

To access the court's public records, a PACER login and password is required.


To obtain a login and password:

Go to www.pacer.gov. Register for a login and password by clicking Register. Once registered, go back to the court's website and click on CMECF Filing. Click the link Eastern District of North Carolina - Document Filing System and login. Once logged in, search for a case by going to QUERY. (Search fields include name, case number or social security number.) Fill in the applicable field(s) and click Run Query. If the search returns more than one case, select the case you wish to view from the list. To print documents from the case, click on the Docket Report link, click Run Report and then select and print the documents you desire. Please note that an access fee of $0.08 per page or $2.40 per document with an audio attachment will be assessed for access to this service.
