03/29/2002 The Administrator of the Division of Environmental Protection gives notice that an application for a renewal of a Water Pollution Control Permit for a mining facility, the Surprise Heap Leach Project, has been properly filed with the Division of Environmental Protection in Carson City. The applicant for the renewal of Water Pollution Control Permit NEV90019 is: Newmont Mining Corporation P.O. Box 388 Valmy, Nevada 89438 The facility is located in Lander County, in Section 4, Township 31 North, Range 44 East, MDB&M; approximately 5 miles south of Battle Mountain, Nevada. This mining operation has used open pit mining methods, and employs cyanide heap leaching techniques to produce gold. The Administrator is constrained to issue a renewal of this water pollution control permit, or to deny the application. The Administrator has made the tentative determination to issue a renewal of the permit.

Bureau of Mining Regulation and Reclamation 03/08/2002 The Administrator of the Division of Environmental Protection gives notice that an application for a Water Pollution Control Permit for the Recon Mining Company, Inc. Pilot/Testing Facility, a beneficiation facility, has been properly filed with the Division of Environmental Protection in Carson City. The applicant for Permit NEV2001105 is: Recon Mining Company, Inc. P.O. Box 21120 Reno, Nevada 89515 The Recon mine is located in Section 11 of Township 36 North, Range 19 East MDB&M;, and the pilot/test facility is located in a warehouse in the City of Sparks, Nevada at 50 East Greg Street, Building A, Suite 104. Both the mine and pilot/test facility are in Washoe County, Nevada. The proposed project consists of mining ore, crushing the ore on-site, hauling the crushed ore in a pneumatic truck trailer to Sparks, transferring the ore to the process facility by pneumatic pressure hose (and/or enclosed auger) and processing the ore using chemicals. Facilities are required to be designed, constructed, operated and closed without any discharge or release in excess of those standards established in regulation except for meteorological events which exceed the design storm event. The Administrator is constrained to issue a water pollution control permit or to deny the application. The Administrator has made the tentative determination to issue a permit. Bureau of Mining Regulation and Reclamation 03/05/2002 The Administrator of the Division of Environmental Protection gives notice that an application for renewal of a Water Pollution Control Permit for the Robertson Project, a mining facility, has been properly filed with the Division of Environmental Protection in Carson City. The applicant for renewal of Permit NEV60035 is: Coral Resources, Inc. Robertson Project P.O. Box 21-1431 Crescent Valley, Nevada 89821 The facility, known as the Robertson Project, is located in Lander County, within Sections 8 and 9, Township 28 North, Range 47 East, Mount Diablo Baseline and Meridian, approximately 30 air-miles southeast of the town of Battle Mountain, Nevada. The project, currently in planned temporary closure in accordance with Nevada Administrative Code (NAC) 445A.444, consists of an open pit gold mining operation with a heap leach pad, a pregnant solution pond, a barren solution pond, two (2) settling ponds, a CIL processing plant for metal recovery, and associated pumps, pipelines, and two (2) monitoring wells. Facilities are required to be designed, constructed, operated and closed without any discharge or release in excess of those standards established in regulation except for meteorological events which exceed the design storm event. Bureau of Waste Management 02/19/2002 Nevada Recycling and Waste Reduction Contracts 2002 Request for Proposals The Nevada Division of Environmental Protection (NDEP) is soliciting proposals for 2002 Nevada Recycling and Waste Reduction contracts. This Request for Proposals is targeting rural municipalities, not-for-profit organizations, schools, the University and Community College System of Nevada, and other public institutions in Nevada. Proposals may be submitted for a one or two year contract term and should be developed using the guidelines in this document. Proposals must be received in the Nevada Division of Environmental Protection, Solid Waste Branch, 333 West Nye Lane, Room 120, Carson City, Nevada 89706-0851 by 5:00 pm on May 1, 2002. Original proposals must be submitted; faxes and e-mail proposals will NOT be accepted. Proposals received after that time will not be eligible for consideration. Bureau of Waste Management 02/23/2002 Request For Public Comment Upon a Draft Written Determination For The Recycling of Hazardous Waste The Nevada Division of Environmental Protection (NDEP) is requesting public comment upon the DRAFT WRITTEN DETERMINATION (WD) for a hazardous waste recycling facility owned and operated by Resolvent, Inc. (EPA ID# NVR000076158). This facility will be located at 831 Deming Way, Sparks, Nevada. The DRAFT WRITTEN DETERMINATION would recognize Resolvent, Inc. as a facility for the recycling of hazardous waste in accordance with NAC 444.8455. Anyone wishing to submit comments on this DRAFT WRITTEN DETERMINATION should do so in writing on or before April 8, 2002 to NDEP at the Carson City address above. An extension of the 45-day comment period may be granted if the request for the extension adequately explains why more time is required to prepare comments. The application for the DRAFT WRITTEN DETERMINATION is available for public review between the hours of 9:00 a.m. and 4:00 p.m., Monday through Friday, at the NDEP address above. Bureau of Water Quality Planning 02/12/2002 PUBLIC NOTICE Lower Virgin River-Total Maximum Daily Load Allocation for Boron Pursuant to Section 303(d) of the Clean Water Act, the State of Nevada is required to develop a list of impaired waterbodies that need additional work beyond existing controls to achieve or maintain water quality standards. The lower Virgin River from the Nevada-Arizona state line to Lake Mead is currently listed on Nevada's 1998 303(d) List for exceedences of the boron and total phosphorus water quality standards. These exceedences typically occur during periods of low flow. In an effort to achieve and maintain the existing water quality standard for boron in the Lower Virgin River, the Nevada Division of Environmental Protection, Bureau of Water Quality Planning has developed a graduated Total Maximum Daily Load (TMDL) allocation for boron, based on water flow, effective at the Nevada-Arizona state line. The Division is issuing this Public Notice and soliciting public comment on the boron TMDL prior to its final issuance and implementation. Bureau of Water Pollution Control 02/21/2002 The Administrator of the Division of Environmental Protection gives notice that a public hearing regarding the proposed modification of National Pollutant Discharge Elimination System (NPDES) Permit NV0023027 for a concentrated animal feeding operation, the Ponderosa Dairy, has been scheduled for 6:00 P.M. January 29, 2002 at the Amargosa Valley Multipurpose Building, 821 E. Amargosa Farm Road, Amargosa Valley, Nevada. Public notice for the draft permit was given November 7, 2001 in the Las Vegas Review-Journal and the Pahrump Valley Times. The Administrator has determined that there is sufficient public interest in this draft permit to warrant a public hearing. The Applicant for the modification of NPDES Permit NV0023027 is Rockview Farms, Inc., 7011 Stewart and Gray Road, Downey, CA 90241-4347. The facility is located in Nye County, Nevada and is in portions of Sections 9, 10, and 15, Township 17 S, Range 49 E, in the town of Amargosa Valley, Nevada. Ponderosa is operated as Dairy 1 and Dairy 2 with Dairy 3 to be added as part of this major modification. Dairy 3 will increase the number of Ponderosa cows and calves by approximately 68%. Dairies 1 and 2 are approximately equal in size in terms of the number of cows housed and acres for confined feeding with a total area of 80 acres. Dairy #3 will add 60 acres to the confinement area. Dairy 1 has an earthen lined pond system that consists of two lagoons and eight ponds. Dairy 2 has an earthen lined pond system that consists of three lagoons. The maximum 30-day average discharge to the two pond systems is 350,000 gallons per day (GPD). Dairy 3 is being designed to accommodate a maximum 30-day average discharge of 275,000 GPD. The Permittee uses a combination of evaporation and land application/reuse to dispose the liquid manure generated by the existing dairy facilities and has proposed similar utilization at Dairy 3. To reduce the nitrogen loading on the reuse fields, the ponds are aerated. To ensure that groundwater is not degraded, the Permittee is being given the option of lining the lagoons and ponds or installing monitoring wells at each pond system. The Permittee is allowed to discharge to surface waters, the Amargosa River, only during storms that exceed the 24-hour, 25-year storm event or as a result of a series of chronic rainfall events.

The applicant for Permit # 0207 is: Nevada Drilling Fluids Inc. 12280 Westridge Drive Reno, Nevada 89511 This project, will be located within Lander County, and is in portion(s) of Sections 2, 13 and 14 of Township 30 N, Range 46 E, M.D.B. & M, approximately 17 miles SE from the community of Battle Mountain, Nevada. The project operation is 90.2 acres of both public and private acres to be mined by open pit methods for Barite with no processing facilities within the described land position noted above. Bureau of Water Quality Planning 12/21/2001 Draft CPP available for comments. The Bureau of Water Quality Planning is seeking public comments on the draft Continuing Planning Process (CPP) document. The CPP defines how NDEP is implementing Clean Water Act (CWA) programs addressing the water quality of surface waters and is a compendium of procedures for planning and implementing water quality management programs. Comments are being accepted until March 4, 2002. Draft 2002 303(d) Listing methodology available for comments. Comments on the Draft 2002 303(d) Listing methodology are being sought by the Bureau of Water Quality Planning. Section 303(d) of the Clean Water Act requires that States develop a list of waterbodies needing additional work beyond existing controls to achieve or maintain water quality standards. The 303(d) List is the basis for targeting water bodies for watershed?based solutions, and the Total Maximum Daily Load (TMDL) process provides an organized framework to develop these solutions. Comments are being accepted until March 4, 2002. Data Solicitation for 2002 303(d) List development. In support of the 2002 303(d), the Bureau of Water Quality Planning is also soliciting the public for data and information pertaining to the water quality conditions of surface waters in Nevada. BWQP staff will evaluate all data and information submissions on a case by case basis to determine whether the information are applicable and useful for identifying impaired waterbodies as required by CWA.
