EPA Clean Power Plan Stakeholder Process
Overview
The EPA finalized the Clean Power Plan (CPP) rule to limit CO2 emissions from existing plants on August 3, 2015. The rule covers emissions from 11 power plants in Utah:
- 5 coal plants under state jurisdiction
- Carbon (189 MW; retired 2015)
- Hunter (1,472 MW)
- Huntington (996 MW)
- Intermountain (1,800 MW)
- Sunnyside (58 MW)
- 1 coal plant under tribal/federal jurisdiction
- Bonanza (500 MW)
- 5 natural gas plants under state jurisdiction
- Currant Creek (567 MW)
- Lake Side 1 (591 MW)
- Lake Side 2 (655 MW)
- Nebo (140 MW)
- Gadsby (252 MW; units 1, 2, and 3)
The EPA established CO2 emissions rate- and mass-based targets for each state (states can opt for either target):
- Utah’s 2030 rate-based target is 1,179 lbs CO2/MWh (37% reduction from 2012 levels)
- Utah’s 2030 mass-based target is 23,778,193 short tons CO2 (23% reduction from 2012 levels)
Response
On February 9, 2016, the U.S. Supreme Court issued a stay of EPA’s “Carbon Pollution Emission Guidelines for Existing Stationary Sources: Electric Utility Generating Units” (aka Clean Power Plan) pending judicial review in the U.S. Court of Appeals for the District of Columbia Circuit and possible review by the U.S. Supreme Court. As a result, the State is suspending its stakeholder process until the rule has been reviewed by the courts. Accordingly, we are canceling the previously scheduled stakeholder meetings on March 1, April 5, and May 3. We will, however, maintain this stakeholder website and email list. We will keep stakeholders informed of new developments regarding the rule.
