Any release of a hazardous substance must be reported as soon as the person has knowledge of the discharge.

 

• TO WATER: Any release of oil to water must be reported as soon as the person has knowledge of the discharge.
• TO LAND: Any release of oil in excess of 55 gallons must be reported as soon as the person has knowledge of the discharge. Any release of oil in excess of 10 gallons but less than 55 gallons must be reported within 48 hours after the person has knowledge of the discharge. A person in charge of a facility or operation shall maintain, and provide to the Department on a monthly basis, a written record of any discharge of oil from 1 to 10 gallons.
• TO IMPERMEABLE SECONDARY CONTAINMENT AREAS: Any release of oil in excess of 55 gallons must be reported within 48 hours after the person has knowledge of the discharge.

If the release detection system indicates a possible discharge, or if you notice unusual operating conditions that might indicate a release, you must notify the Underground Storage Tank Program in Anchorage within 7 days:

Oil and Hazardous Materials Incident Final Report (PDF 29K, updated 9/19/2000) – This report is required by State regulation 18 AAC 75.300(e). It is due within 15 days of cleanup completion or, if no cleanup occurs, within 15 days of the discharge.

Monthly Spill Log (Word 283K, updated 2/6/2013) – A person in charge of a facility or operation shall maintain, and provide to the Department on a monthly basis, a written record of any discharges of oil from 1 to 10 gallons to land.

Transport, Treatment & Disposal Approval Form for Contaminated Media (PDF 44K, added 12/10/2014) – Complete and submit this form to the ADEC Prevention Preparedness and Response Program whenever contaminated soil from a spill site is transported offsite for treatment (e.g., thermal desorption or bioremediation) or disposal. The form must be submitted for ADEC approval prior to transport of the soil from the incident site. Contaminated soil shall be transported as a covered load in compliance with 18 AAC 60.015. Note: Bonded treatment facilities are allowed to co-mingle contaminated soil for treatment under their approved facility operations plan. Post-treatment soil samples are collected and analyzed at regular intervals to insure that the contaminants are successfully treated. Because the post-treatment analytical results for co-mingled soils are provided directly to ADEC, the Responsible Party does not have to provide a separate copy of the post-treatment analytical results as indicated in the form.
