Because family law actions, such as divorce, child support, and determining parenting rights and responsibilities, can have serious long-term legal and financial consequences, it is strongly recommended that you consult a lawyer and carefully consider all of your options. Uncontested Divorce (Agreement of Both Spouses)

These forms may be used when both spouses are in complete agreement on all issues in the divorce. The forms must be totally completed by both spouses before filing with the court.

1. Divorce with Agreement – No Children

Summary Divorce (Uncomplicated, Under $50,000 Net Assets)

These forms are for uncomplicated divorces. The forms may be used when both spouses are very likely to reach an agreement on all issues in the divorce. Net assets of the marriage must be under $50,000, not including the home.

1. Summary Divorce with Children (Under $50,000 net assets not including home)

Contested Divorce

If there are issues in the divorce upon which both spouses do not agree and are unlikely to reach agreement, the divorce is contested. You should not use the Uncontested or Summary Divorce forms if your divorce is contested.

Uncontested Parenting Rights and Responsibilities Between Unmarried Parents (Agreement of Both Parents)

Unmarried parents of minor children can ask a North Dakota District Court to determine the parenting rights and responsibilities of the parents. Parenting rights and responsibilities are all rights and responsibilities a parent has concerning the parent's children.

These forms may be used when both parents are in complete agreement on all issues in determining parenting rights and responsibilities between unmarried parents. The forms must be totally completed by both parents before filing with the court.

Contested Parenting Rights and Responsibilities Between Unmarried Parents

If there are parenting rights and responsibilities upon which both parents do not agree and are unlikely to reach agreement, the action is contested.  You should not use the Uncontested Parenting Rights and Responsibilities forms if you and the other parent are not in agreement on all issues. .

Child Support

These forms may be used to request review and amendment of a child support order. There must already be a court order setting or reserving child support. These forms are not used to ask the court to change parenting time (visitation) or residential responsibility (custody).

Parenting Time (Visitation)

These forms may be used to request assistance with a parenting time (visitation) issue. There must already a court order giving you or the other party parenting time (visitation) rights. These forms are not used to ask the court to change residential responsibility (custody).
