All filings made by an electronic record (e-filing) shall have the same effect as
a paper filing. In addition, all filings are subject to a review by the staff of
the Commission to determine if the filing meets the minimum filing requirements
set forth in the Commission’s Rules of Practice and Procedure, 26 Del. Admin. C.

All documents that are e-filed using DelaFile are publically available to anyone
who logs into the DelaFile website. The Commission and its staff assume no liability
(expressly or implicitly) if any person mistakenly e-files any confidential document
or confidential information as a public comment or document using the DelaFile website.
You may request that the Commission accord confidential treatment to some or all
of the information contained in a document that you wish to e-file using the DelaFile
website. See Section 1001-1.11 of the
Rules for the requirements to follow for requesting such confidential treatment
of documents (including the attestation required). For a listing of materials that
are exempt from public disclosure, see
29 Del. C. §10002(l).
DO NOT E-FILE ANY CONFIDENTIAL DOCUMENT OR CONFIDENTIAL INFORMATION USING THE DELAFILE
WEBSITE UNLESS YOU SIMULTANEOUSLY ALSO E-FILE 1) A REDACTED, PUBLIC VERSION OF THE
SAME DOCUMENT; AND 2) AN ATTESTATION THAT THE INFORMATION IS NOT SUBJECT TO PUBLIC
INSPECTION OR DISCLOSURE.
If you e-file any confidential documents without a corresponding redacted, public
version and attestation, your filing will not meet the Commission’s minimum filing
requirements and will be rejected. All rejected documents are not considered as
legally filed documents per the Commission’s Rules and do not start any time limits
set for a response from the Commission or its staff.
