The Supreme Court Clerk's Office is the central point of contact for doing business with the Supreme Court of Appeals of West Virginia. The Clerk's Office accepts papers for filing, preserves all court documents and information, and performs a wide variety of duties for the court, the public, and attorneys. We are happy to answer questions regarding the status of cases before the Court. We will also answer routine procedural questions. However, we cannot provide legal advice or referrals.

Obtaining copies of papers filed

Cases on the argument calendar: In cases that are placed upon the argument calendar, the Clerk's Office posts the lower court's order and the briefs filed by the parties on the appropriate argument calendar page.

Other cases: All public filings are available for inspection during office hours. Charges for copies vary depending on whether the cases are pending or closed. We are able to retrieve pleadings in most closed cases from archive materials; it is advisable to allow sufficient time for processing a record request that must be retrieved from archived material. In cases of significant public interest, we will make filings available on this Web site. The charge for copies is as follows: $1 per page for all opinions, 25¢ per page for copies of documents in pending cases and $1 per page for documents in closed cases. Fax or e-mail charges are $5 for the first page, $2 for the second page and $1 per page after that. There is a $2 per page charge for any documents reproduced from microfilm.

Opinion Summary Mailing List

This e-mail bulletin is prepared several times a year by the Clerk's Office. Subscribers to the free service receive periodic e-mail messages containing summaries of recently-filed opinions, organized by topic for easy reference, along with links to the full text opinions.

HAND DELIVERIES

The Clerk's Office is located on the third floor of the East Wing of the State Capitol, and is open for business 8:30 am to 5:00 pm Monday through Friday. The office is closed on state and federal holidays.

Metered parking is available on California Avenue, which runs directly along the East Wing, and at the Greenbrier Street entrance on the west side of the capitol.

Important Notes to Filers

• Guide to Preparing an Appeal from a Circuit Court Decision: The Guide was prepared by the Clerk and is intended to explain many of the practical points that are involved in preparing an appeal under the Revised Rules. The Guide is not legal authority and is not a substitute for reading the rules carefully.
• Due to the passage of Senate Bill 428, there is now a $200 filing fee for docketing civil appeals (including family court cases), effective June 16, 2011. The filing fee is due when the notice of appeal is filed.
• All filings under the Revised Rules must be received in the Supreme Court Clerk's Office on the date they are due. It is not sufficient to mail filings on the date they are due. Review the Guide and Rule 38 for more information.

Certificates of Good Standing

To request a Certificate of Good Standing signed by the Clerk, contact the Clerk's Office at (304) 558-2601. Provide your name and the city and state of your current residence. The cost is $5 per certificate.

Courtroom Tours

With advance notice, the Clerk's Office is usually able to conduct brief tours of the beautiful supreme court chamber designed by architect Cass Gilbert. The tours are suitable for school groups of all ages and other interested visitors. Tours can accommodate up to eighty persons. The courtroom is usually not available for tours on days when the Court is holding oral argument. Please check the argument calendar to avoid a conflict. Argument Webcast

On days when the Court hears oral arguments, the Clerk's Office provides a live webcast. Under Rule 42(j): "The live webcast of oral arguments is provided by the Court as a public service and is not intended to provide an official record of proceedings. The webcast may not be rebroadcast in any manner, in whole or in part, without the prior express written permission of the Court." The number of simultaneous connections is limited; during cases of high demand some users may not be able to connect. The argument webcast is not archived and recordings are not available.
