The Emergency Planning and Community Right-to-Know Act (EPCRA, 1986) implemented two chemical reporting programs: on-site chemical storage inventory (Tier II) and chemical releases under the Toxic Release Inventory (TRI). EPCRA uses several standards defined by the Occupational Safety and Health Administration (OSHA) Hazard Communication Standard (HAZCOMM) to establish reporting thresholds under the Tier II program. HAZCOMM defines the term "hazardous chemical" and requires an OSHA facility to have a Material Safety Data Sheet (MSDS) available for review by all employees for each hazardous chemical stored at the facility. EPCRA uses these parameters as thresholds that require a facility to submit annual inventory information for each hazardous chemical that exceeds a storage threshold quantity as defined in the Tier II regulations. The TRI program requires that certain facilities report annually if they manufacture, process, or otherwise use certain toxic chemicals, including releases to the environment that result from these activities.
