Although Home Use is permitted in some cases, each software agreement has individual terms of use. For additional terms and conditions, please see the software's End User License Agreement (EULA). If you have any questions please submit a request online at http://itservicedesk.nih.gov or call 866-319-4357, 301-496-8294 (TTY). Below is a summary of available products with current "Terms of Use":

  • Adobe

The primary user of the Computer on which the Software is installed may install a second copy of the Software for his or her exclusive use on either a portable Computer or a Computer located at his or her home, provided that the Software on the portable or home Computer is not used at the same time as the Software on the primary Computer. The Second copy of the Software must be used solely for the benefit and business of that volume licensee.

  • EndNote

There is no limit on the number of installations, and anyone who has installed the software prior to December 31, 2016 and applied the license key will be able to retain and use that installation indefinitely.

    Patches Available?
Any installation will be able to apply the quarterly patches and any major versions that are released during the term of the agreement. The application automatically checks for available patches on startup. After December 31, 2016, there no longer will be access to patches and new editions, and users will not be able to add the software to any new desktop machines.

  • FileMaker

NIH users are provided with the option to make and use a second copy of FileMaker Pro or FileMaker Pro Advanced for home or portable use.

  • IBM SPSS

An Authorized User is a unique person who is given access to the Program. The Program may be installed on any number of computers or servers and each Authorized User may have simultaneous access to any number of instances of the Program at one time. Licensee must obtain separate, dedicated entitlements for each Authorized User accessing the Program in any manner directly or indirectly. For example: via a multiplexing program, device, or application server through any means. An entitlement for an Authorized User is unique to that Authorized User and may not be shared, nor may it be reassigned other than for the permanent transfer of the Authorized User entitlement to another person.

  • MacVector

Secondary use is allowed for Standard Licenses. However, only one MacVector license may be run on one local network at a time. Personal MacVector licenses can only be downloaded and used on one machine.

  • Mathematica

A single user/single machine license allows for one office machine. If this single user license has active Premier Service, a complimentary Home Use license is allowed for a second machine. That second machine can be a lab laptop, travel laptop, or a home machine. These licenses cannot be used concurrently.

  • McAfee

No Secondary Use. Home use is not included as a part of a product purchase, but it is available for purchase as a separate license.

  • Microsoft Home Use Program

Under previous Microsoft agreements, NIH staff had the opportunity to participate in a Home Use Program. With the current Microsoft Enterprise Agreement, which began on June 29, 2014, the Home Use Program is not available.

Microsoft Office 365 (G4) is configured to allow the installation of one license on up to 15 instances as follows:

    • 5 instances - Laptops/PCs (including the MS Surface Pro)
    • 5 instances - Mobile Cellular Devices
    • 5 instances - Tablets

The Office 365 subscriptions were purchased for official government use; all of the standard NIH policies apply, including the limited personal use policy (http://oma1.od.nih.gov/manualchapters/management/2806/).

  • Oracle

Named user licenses allow for secondary use, but secondary use is primarily dependent on the product.

  • SAS

For purposes of this Subsection, "PC Software" means any Standard Product Suite Software licensed for use on personal computers or workstations by DHHS hereunder.

The following additional terms shall apply to Home Use copies of PC Software.

    1. The identical copyright notice and any other proprietary rights notice found on the original PC Software media must be maintained on all Home Use copies.
    2. DHHS will maintain records of the names of all employees using the PC Software for Home Use and will provide EIS and/or SAS with a copy of such records upon request.
    3. DHHS will inform all DHHS employees authorized to use the PC

Software for Home Use of the relevant terms of this Agreement, as modified herein, and any related user documentation, and will be responsible for their adherence to such terms.

DHHS contractors and any other party who is not an employee of DHHS may not use PC Software for Home Use.
