Annual Reports

2009 Drug Law Changes, 2016 Annual Report (11/16)  This is the latest in a series of reports on the impact of the 2009 drug law changes.  The report presents trends on arrests, indictments and commitments to prison for felony drug and specified property offenses, through 2014.  Trends in felony drug court activity are also presented.  County-specific data are provided in tables in the Appendices.

New York State Felony Processing Final Report, Indictment through Disposition, January - December 2015  (11/2016) Processing of felony cases in New York State’s superior courts and satisfies the reporting requirement found in Sections 837-a(1) and 837-a(2) of the Executive Law.

New York State 2015 Report on Environmental Conservation Law Hazardous Waste and Waste Disposal Offenses (11/2016) Information related to the processing of persons charged with violations of various provisions of the Environmental Conservation Law and satisfies the reporting requirement found in Sections 837-a(1), 837-a(5) and 837(4-a) of the Executive Law.

New York State 2015 Report on Felony Insurance Fraud Offenses (11/2016) Information related to the processing of persons charged with Insurance Fraud felony offenses and satisfies the reporting requirement found in Sections 837-a(1) and 837-a(5) of the Executive Law.

Crime in New York State 2015 Final Data (9/2016) (25 pages, 578 kb pdf)
This report details preliminary index crime statistics for New York State in 2015 and satisfies the reporting requirement found in Section 837 (4)(c) of the Executive Law. Annual historical crime data from 2006 through 2015 for New York State as a whole and its two regions - New York City (Bronx, Kings, New York, Queens and Richmond counties) and Non-New York City (the 57 remaining counties in the state) - also are presented, as is an index crime summary by county for 2014 vs. 2015.

Motor Vehicle Theft and Insurance Fraud 2015 Annual Report (9/2016) This report details the activities of the New York Motor Vehicle Theft and Insurance Fraud Prevention Demonstration Program as required under Section 846-1(3)(h) of the Executive Law.

New York State Violent Felony Offense Processing Report 2015 (8/2016) Information related to the processing of persons charged with Violent Felony Offenses and satisfies the reporting requirement found in Sections 837-a(3) and 837 (4)(f) of the Executive Law.

2015 Asset Forfeiture Annual Report (8/2016) DCJS is statutorily required to publish an annual report detailing the value and distribution of assets seized as a result of criminal proceedings in the state, pursuant to the state’s Civil Practice Laws and Rules (CPLR) Article 13-A and Penal Law Article 480. This information is reported to DCJS by district attorneys’ offices and/or police agencies.

New York State Law Enforcement Agency Accreditation Program 2015 Annual Report (6/2016) The Law Enforcement Agency Accreditation Council oversees a voluntary accreditation program for police departments in New York State. This report of the council’s activities satisfies the reporting requirement found in Section 846-h(10) of the Executive Law.

Committee for the Coordination of Police Services to the Elderly 2015 Annual Report (6/2016) Information about Committee activities and policing programs aimed at enhancing the safety of elderly persons. This report satisfies the reporting requirement found in Section 844-b(3-a) of the Executive Law.

2014-2015 Annual DCJS Performance Report (5/2016) Performance data for the Division of Criminal Justice Services for 2014 and 2015 satisfies the annual reporting requirement found in Section 837(12) of the Executive Law.

Gun Involved Violence Elimination (GIVE) Initiative 2014 Annual Report (12/2015) This report provides information about GIVE, which provides funding to law enforcement agencies in 17 counties Upstate and on Long Island and requires those agencies to use evidence-based strategies to reduce gun violence and firearm-related homicides. It satisfies the reporting requirement found in Section 837-a(8) of the Executive Law.

Domestic Violence & Violence Against Women

Domestic Homicide in New York State
These reports include statewide and regional statistics on domestic homicide with special focus on intimate partner homicide.  Demographic characteristics of homicide victims, as well as the respective circumstances surrounding the homicide incidents, and the types of weapons used are summarized.

The 2015 report, issued in July 2016, shows domestic homicides decreased in 2014, with 114 reported. That year also had the fewest number of intimate partner homicides reported: 64. As in previous years, the report shows that women continue to be most at risk for violence by someone they know.

Arrests and Arraignments Involving Strangulation Offenses Nov. 11, 2010 – June 30, 2012 (9/2012)
This research brief details arrest events – charges brought at arrest or arraignment – involving the crime of strangulation, which was added to the state’s Penal Law on Nov. 11, 2010. More than 17,000 individuals were arrested for strangulation offenses across New York State in the 20 months following the law’s effective date.

Drug Law Reform

2009 Drug Law Changes, June 2012 Update (07/12)
This report expands upon the June 2012 presentation, going into further detail regarding the impact of the 2009 drug law changes on felony drug arrests and indictments, as well as on initial case dispositions including diversion to treatment, commitments to prison and prison sentence lengths; offender treatment participation is also examined.

Felony Drug Court Activity Among Offenders Eligible Under 2009 Drug Law Changes, 2008-2010 (11/2011)
A joint collaboration between DCJS and the Office of Court Administration, this report examines the impact of the 2009 drug law changes on felony drug court screenings and admissions throughout the state.

Preliminary Impact of 2009 Drug Law Reform October 2009 – September 2010 (10/10)
After one year of full implementation, this update reviews the impact of the new drug laws on admissions to prison, drug court activity and admissions to treatment.

Felony Drug Arrest, Indictment and Commitment Trends 1973-2008 (2/2010)
Information on the criminal justice processing of felony drug cases, beginning in 1973, when the Rockefeller Drug Laws took effect and ending in 2008, the year before the reforms were enacted.

Profile of Felony Drug Offenders Committed to New York State Prison 2008 (2/2010)
Demographic and criminal histories of drug offenders admitted to prison in 2008, the year before the drug law reforms were enacted. This report establishes a baseline for future reports assessing the impact of the reforms to determine whether they are working as intended.

Hate Crimes in New York State

This report details hate crime incidents that law enforcement agencies reported to DCJS, including data on the number of incidents and type of bias reported. It satisfies the reporting requirement found in state Executive Law Section 837(4-c).

Juvenile Crime and the Juvenile Justice System

New York State Juvenile Justice Advisory Group 2014 Annual Report (9/2015) New York’s Juvenile Justice Advisory Group is a federally-required panel of criminal justice, human service, research and court professionals tasked with the responsibility of improving the state’s juvenile justice system and ensuring compliance with federal mandates. The panel is responsible for overseeing the development and implementation of the state’s plan to comply with federal juvenile justice mandates; distributing nearly $2 million in federal grants to fund delinquency prevention, effective interventions to justice-involved youth and juvenile justice systems reforms; and advising the Governor and Legislature on effective juvenile justice policies. This report satisfies the statutory requirement to report to the Governor and Legislature annually.

Missing Persons, NYS Missing Persons Clearinghouse

New York State Missing Persons Clearinghouse 2015 Annual Report (6/2016) This report details the activities of the Clearinghouse, provides data on the number of children under the age of 18 and vulnerable adults who were reported missing in 2015, among other information. This report satisfies the reporting requirement found in Section 837-f-12 of the Executive Law.

Child Locator Report (6/2016) This one-time report is submitted pursuant to Chapter 430 of the Laws of 2015 which requires DCJS to publish such report and provide it to the Governor, the Temporary President of the Senate and Speaker of the Assembly.

This report summarizes findings from a survey administered in December of 2010 to incarcerated individuals in the New York State prison system. The survey was developed in response to policy issues raised by a cross-systems Subcommittee on Children with Incarcerated Parents.

Results First

Seeking to identify the most effective correctional programming available, New York is now utilizing the Results First computerized cost-benefit model also in use in 20 other states. Results First uses national research to identify programming options that work and then predicts how each of these options would impact the re-offending rates of a state’s correctional population.

With the assistance of the Pew Charitable Trusts and the John D. and Catherine T. MacArthur Foundation, DCJS has customized the Results First cost-benefit tool for use in New York State and conducted simulations that help determine which interventions generate the most public safety at the lowest cost to taxpayers.

The Results First initiative also places strong emphasis on a program’s integrity and performance. Fidelity and evaluation systems are utilized to verify that funded programs are delivering effective services and that the outcomes predicted by the cost-benefit modeling are being achieved. This work is a natural extension of New York’s commitment to data-driven decision-making. Results First updates will periodically be posted to this webpage.

Case Study: New York’s Investment in Evidence-Based Policymaking (1/2016)
Published by the Pew Charitable Trusts and the MacArthur Foundation, this case study details how New York State has used Results First to identify cost-efficient, effective alternatives to incarceration programs, distribute funding to those programs and develop a technical assistance program to help ensure they are implemented as intended to achieve desired outcomes.

Sex Offender Registry

New York State Sex Offender Registry 2015 Annual Report (6/2016) This report is submitted as required by New York State Correction Law §168-p (4) and §168-s. It includes an overview of the Registry’s activities in 2015 and statistics detailing the number of calls to the Registry’s toll-free telephone number and searches of the Registry conducted as a result of those calls, among other data.

Former Governor Paterson’s Hate Crimes Task Force, which established in January 2009 following a series of bias-motivated attacks across the State, outlined a multifaceted approach to addressing the issue. The proposals include the development of curricula for students and school staff, enhanced training for law enforcement on hate crimes, and the implementation of a consistent approach that agencies and community-based organizations should adopt when responding to victims.

NYS Commission on Sentencing Reform

Executive Order No. 10
New York State Commission on Sentencing Reform

Governor Eliot Spitzer established the New York State Commission on Sentencing Reform pursuant to Executive Order No. 10 on March 5, 2007 to conduct a comprehensive review of New York’s “current sentencing structure, sentencing practices, community supervision and the use of alternatives to incarceration” in order to provide the State with “crucial guidance to ensure the imposition of appropriate and just criminal sanctions, and to make the most efficient use of the correctional system and community resources.”

Following its inaugural session, the 11-member Commission chaired by Denise E. O’Donnell, Assistant Secretary to the Governor for Criminal Justice and Commissioner of the Division of Criminal Justice Services, conducted a series of meetings where state and national sentencing experts provided an in-depth review of New York’s existing sentencing structure and practices, the many challenges facing that system and constructive proposals for reform. In its Preliminary Report, the Commission concludes that while New York has made commendable progress in enhancing public safety through the combined use of limited correctional resources and a broad reliance on community-based alternatives to incarceration, there is tremendous opportunity for improvement.

NYS COMPAS, (9/2012)
Presents findings from a study which examined the effectiveness and predictive accuracy of the New York State COMPAS-Probation Recidivism Scale. This scale predicts the likelihood of rearrest for any felony or misdemeanor offense over a two-year follow-up period for offenders under probation supervision. The study also examined the prevalence of 19 risk/need factors among study cases and the extent to which these factors were correlated with the likelihood of rearrest.

Analysis of ATI Program Participants Report, (9/2012)
Provides demographic and criminal history information for individuals served by the Alternatives to Incarceration programs funded by DCJS. Data shown is for individuals discharged from these programs between January 2008 and December 2010.
